When overtime applies

Under the federal Fair Labor Standards Act, non-exempt employees must be paid at least one and a half times their regular rate for hours worked over 40 in a workweek. Some states go further: California, for example, also requires overtime after 8 hours in a workday. Salaried employees who meet the exemption tests do not get overtime.
